"fake" vs. "aftermarket"
I know the obvious ones, i.e. if the metals are fake, etc. What about when you have a band that is solid SS with real gold and they both have all the Rolex markings, is there a difference between "fake" and "aftermarket" or is it 2 words for the same thing? Does Rolex authorize any company to make aftermarket bands with their logo or are they all violating their copyright?

A fake would have the Rolex logo, an aftermarket would fit a Rolex watch but not be marked with the crown or Rolex name anywhere. There are countless aftermarket bands made to look like an Oyster bracelet but only ones made by Rolex should have the crown on it.

Fake would denote a trademark infringement, trying to portray an item as authentic when it is not produced by the trademark holder (Rolex).
Aftermarket is a part that is made to "fit" an authentic product, but it is not portrayed as authentic nor does it bear any markings, in the case of a Rolex, the crown, etc. |
