It's been 9 months so I agree with you - he may never make restitution. The criminal case that is dragging on doesn't stop you from filing a lawsuit, though.

This way if he ever gets any money in the future you might get your money back.

Nice. Not the conclusion we all wanted, but some justice and a criminal record to follow him.
Thanks for the update.

I don't necessarily wish this guy death, but always justice to scumbags like him.

What a dirtbag! Sorry OP.

http://nypost.com/2015/06/17/crooked...-his-birthday/

OP was far from the only one... I'm actually happier when they scam the wrong person and justice is done outside of the courts.

Reading another article, he also has to pay restitution, but unfortunately the victims will probably never collect.

motivation, incentive and opportunity. Article from 2006

Marvin Rafeld has owned Fourteen Wall Street Jewelers for 26 years, but the adversity of the past five have taught him more about the business than he could have imagined.

He has lost nearly half of his customers, many of whom worked in buildings that were converted to condominiums after Sept. 11. His largest corporate client, which he declined to name, eventually moved away, too. And his profit margin is much lower because he is offering more discounts. Mr. Rafeld, 52, has been forced to adapt.

"I'm in a much more competitive position than I was a couple of years ago," he says.

Because fewer people were walking through the front door, Mr. Rafeld contacted customers who had left lower Manhattan. Now much of his business is done over the phone as those clients order engagement rings, watches and bracelets from their desks in midtown.

"Customers who started as watch-battery clients are now buying bracelets for $5,000 from me," he says. "I've maintained these customers for that long."

A Web site is also in the works. More people now shop for jewelry online, says Mr. Rafeld, who wants to make it easier for those who can't get to his shop.

"These people who work on Park Avenue are talking each day with people all over the world," he says. "They have referred me to their colleagues and friends in London, France and Brazil."

When Tiffany & Co. opens a location down the street next year, Mr. Rafeld will work on Saturdays.

"I'm no competition to Tiffany's, but they will increase the foot traffic," he says. "And if I can attract at least one new customer of that caliber, then it's worth it."

File a Police report and take that to your closest AD so it can be entered into the Rolex database. If it ever comes in for service, they will confiscate it and contact the police.

Nice to see him sent to jail but it's horrible for everyone he scammed. I am sure no one will see a dime from him.

It is a sad story of his slide from being a self-sustaining retailer has hurt so many innocent people.

Some take adversity (like the WTC 9|11 impact to his business) and survive with their scruples intact. But others turn on their fellow citizens to further victimize them.

In this case, he slid into crime to make ends meet and now will pay the consequences.

Thanks for the update OP. Sorry that you may never see restitution - but if he makes a full turnaround in life you may actually get something back.

It just amazes me that people don't insure their watch. They insure their car, home, possessions inside the home, boat, motorcycle, phone, etc., but not their luxury watch. Crazy!!!

Yup.
The cost of floaters is well worth the peace of mind in return.
Hate to hear of occurrences like these.

Wow crazy story. Thats awful. You might be able to find him though. As he had his business registered and you know who it is. Its harder to find someone who mugged you with a mask on than go to a shady business and get scammed.

How hard can it be to find him being locked up in a cell?

Sorry to hear about your situation. The cash may be lost but I hope you at least recover the watches.
