What about these shirts though? They are using the Rolex brand name, and are likely made by the people selling them on Ebay. It doesn't seem all that different than selling a fake watch, just it's a fake T-shirt. Well, it's a real T-shirt, but you know what I mean.

Short answer: yes, it is illegal to use the intellectual property of another without first receiving permission from the owner of the intellectual property. And yes you can face civil and criminal penalties for selling fake things, whether it is watches, shoes, handbags, or even T-shirts.

I am not speculating about this particular listing or seller...just stating the law.
