Demand a return. Maybe one of the attorneys can chime in here with your rights, but your transaction was with the AD. Therefore, I would pressure them. Don't worry about Rolex USA inc, that's the AD's problem on how to square it up.

Tell the AD: you want a refund. Brand new luxury item, it's already gone on too long. If they do the return immediately, then you'll consider buying another new watch there. If they don't human-up, you'll dispute the credit card charge etc.

Don't forget, you can also name & shame the AD.

AD should not be out of equation here. If you think AD's response is not satisfactory escalation should be Rolex. "I called rolex HQ in NY and they told me basically that it is up to the AD". Rolex saying that is very average to say the least. Might need to call them up again and let them know you will file this with consumer affairs.

Exactly when you consider the vast amount of Rolex watches made each year the amount of problems are a very very very small amount.Sure it should not happen but its just a watch made out of many parts.And like most man made machines afraid some machines go wrong and that's what the warranty is for.

Well first the cyclops is just stuck on the the crystal surface so any water droplets must be under the crystal or cyclops glue has a gap for water to get in.Now condensation will quite normally occur when any warm/hot watch is suddenly exposed to a cold environment i.e. if you enter cold water then shortly after warm/hot water or visa verso. Indeed...I mean no offence to the OP but the reality is that Rolex must determine whether there is evidence of the watch being opened and re-closed buy the user resulting in damage to the gasket.

I would wait and see what response you received from the A.D. If you're chasing them and they still have not responded fully, I would make them aware of this thread. If they still do not respond fully at that point, I would name and shame them here and on any other watch forum you can. The way they have dealt with this so far has been utterly unacceptable. You deserve much better. The other option for escalation, as other people have observed, is your credit card company, presuming that you paid by credit card, which most people would. I hope this resolves and that you receive a brand-new green Sub! It's a beautiful watch.

A rare occurrence with a new Rolex....replacement is a must. Legal action against the AD (since they are making the call) is in the cards. Good luck mate.

So sorry to hear this. A mechanical watch is just that... a machine. Machines fail, a brand new car comes off the lot and the engine seizes, extremely rare but it can happen. That being said, I'd say that a brand new watch or a full refund from the AD is in order, nothing else would suffice in my opinion.
My first step would be to file a dispute with my CC company, this can be dropped at any time I would assume once you're satisfied. I'm not sure of the time frame that you have to do this and wouldn't want you to get stung because the AD is taking it's time on this, I'd file the dispute right now, today. I'd let the AD know and demand a refund, just my .02.
Don't be angry at Rolex as a whole, as we all know machines break. How that failure is handled by the company is where they sink or swim in peoples minds.
I can't imagine that during the QC process at Rolex that there is not a pressure test done?

Rolex do the right thing simply replace the watch with a brand new right out the box like for like and for a good will gesture a full free service as and when its required, Rolex its called looking after your customers.
