seized goods by border force

Hi Guys

has anyone got any experience with regards to dealing with a watch which was posted and now siezed by UK BORDER FORCE.

Also is there anyway of finding out what the RRP of a rolex submariner hulk was in 2016 ?

Did they seize your watch after you posted it, and wanted it, so they seized it? Or did they seize and post about seizing it, almost as if to brag?

Did you purchase the watch overseas and had it posted to yourself in the UK? Where did it come from? Have you been given the opportunity to pay duty and vat on the purchase? Why is 2016 relevant?
These are just some of the questions you should be prepared to answer if you want assistance.

I was told many many years ago that in order to resolve issues you should ask the first question and then deal with any response by asking the next question and then deal with that response, so essentially one question at a time.

So the first question is; why has the watch been seized?

Did you receive an documents from the UK customs with questions about the watch?

UK customs probably hold the watch beacuse they want to know how much you paid for the watch so they can calculate the VAT you have to pay of over the value of the watch to import it into the UK. You can prove this with some documents like an invoice or a print of the listing and a print of the payment (bank or creditcard details).

The amount you paid for the watch is relavant in this case and not the MSRP of the year 2016.
Because the VAT will be calculated over the current value.

If the watch came from outside the EU they’ll want VAT from you

I feel like I understand. To me it sounds like he was hoping to receive a 2016 Hulk in the mail. It was undervalued and detained (to me seized means it’s gone forever). He is trying to resolve it by paying the custom duties and any related fines but since the watch is from 2016, he is proposing that he should only pay the duty on the retail price from 4 years ago, not the current retail or grey market price.

the watch was purchased in Greece originally by my uni friend in 2016, ,it was sent over to me from outside of EU, it was siezed as it was undervalued by friend on the documents

IMO, you’ll need to provide proper proof of purchase / receipt from the seller, pay the taxes and or import duties if applicable, and any fine they impose.

It sounds like HMRC have been in touch with you, what do they say? Are they asking for proof of purchase? If you bought the watch it should be very easy for you to prove what you paid, they will make a determination as to it's value and ask you to pay the duty. If they believe that you have acted illegally they may escalate it and/or keep the watch.

Worth remembering that even if the watch was sent to you for free as 'a gift' it needs to be declared correctly and vat/duty paid.

'Goods sent as a gift that are over £39 in value are liable to import VAT, Customs Duty also becomes payable if the value of the goods is over £135.' (from HMRC site).

Whatever information they ask for, my advice is to be 100% upfront and straight with them because if they suspect the false declaration (undervaluation) was deliberate the watch can disappear permanently and a nice big fine sent to you instead.

You are importing a watch into the UK. Taxes and duties need to be paid for them to release this item to you.

Once you make arrangements to pay those duties, they will release the watch to you. This is pretty normal for importing.

If applicable taxes and duties have already been paid at some point, all you need to do is prove this to them with the appropriate documents.
