black bay 58 - AD issue

So a while back i go to an AD in the UK and ask to be put on a wait list for the 58.

A week later I'm told they cannot put me on the wait list unless i pay 50% deposit, or its likely to be into next year before i get one as demand is so high.

so reluctantly i pay 50%

now I've decided a datejust would be a more sensible purchase so explained i'd like to cancel my order and get the payment refunded.

They refused and say they will not give me the money back.

which seems a little odd when the reasoning for them insisting on 50% payment is because demand is so high.

if i have to now purchase this when it arrives i will sell it straight away,, so if anyone wants one mine will be for sale at list price

Sorry to hear, how did you leave the deposit? I would speak to the authorities as this does not seem legal.

In addition, this is yet another reason to never leave a deposit for a promised future product.

usually a non refundable deposit is transferrable to in store credit for a different watch if they wont give you your money back. If it was stipulated as non refundable then that is probably your only option

my girlfriend said to her at the time
"If he's (me) not being good can i get my money back?"

that would have been a good opportunity to say ,,, 'no refunds"

considering they said so many people want to buy it, you have to pay to get on the waiting list, otherwise it would be next year , then seems a weird situation where i have to buy a watch that apparently so many people want.. oh well

What were the conditions surrounding the deposit and were they in writing? For example did you get a receipt saying it was a refundable deposit.

Poor form by the AD. Was that condition put in writing when the deposit was made? If not, I can't see how they would be able to enforce that.

Strange indeed. I wouldn’t be happy with people holding on to my money.

Were you looking to purchase the DJ from the same AD? If not, they are just a little sour but shouldn’t treat you this way.

i'll narrow it down to one near Glasgow/Scotland in a posh shopping arcade.

Think this is resolved, manager just now needs authority of area manager to issue a refund. but strange experience .

especially as they gave me an ultimatum, pay half now (even though they couldn't give a delivery date) or wait till end of the year/next year.

their whole rational for this was there is such huge demand for the watch and the waiting list was higher than supply.

when i asked for the refund they then said ,, they may end up getting stuck with it ,, very odd.

oh well hopefully onwards and upwards date just (116200) ,, but not from this AD

What the deal with these. I’m surprised a tudor is a list item.

Gmt ok maybe. But the fifty-eight, is there really a waiting list?

I’ve only just decided today this should be my wife’s beater to save the jubilee and Pepsi.

Would like one of these for her but it sounds like a waiting list piece, really?

Some ad not only Rolex or Tudor.. deposits are not refundable but can use it to buy something else...store credit.

It's as simple as letting them know you are on the largest Rolex / Tudor forum on the internet.

They can get advertising (positive/negative) depending on how you look at it.

How can they expect the deposit to be non-refundable when you haven’t even seen or tried the watch? I had to place a £500 deposit at a UK AD to be first on their list for the BB58 but only on the condition that it would be refunded if I don’t like the watch.

Not odd they were obviously talking sales bollix and you should go there and tell them you've called them out publicly on the biggest watch forum on Planet Earth and they better watch their step in future because the Rolex SM community is watching them.

the moral of the story is don't pay a deposit ever... anybody. I don't.

As long as people continue to pay them then AD's will continue to ask for them. Its not like its a watch they are having to order special for you as they would be getting one anyway. This expectation of holding money for unknown periods of time is out of hand.

You have answered your own question.

It is not whether the demand is high or low for that watch, it is about losing a confirmed customer to another Rolex dealer.

(amazes me that people are paying and staying on a list for a Tudor now, but that is a whole other thread).

An AD can not operate like that. You can report this to Rolex and explain the scenario. Even by threatening to do this to the AD I’m sure they will change their mind.

To me this would only be acceptable if the watch were to be ordered especially for me with my name documented for that purpose, not with some vague stipulation that I'm on a waiting list.

I think you would do well to read the fine print on whatever receipt you got for the deposit.

I'm sure there were lists when the more popular new Black Bay models were announced. That's less a reflection on limited demand and more that some folks want to have it the moment it arrives in the store. I think we just weren't talking about it at the time because lists in general weren't the big topic they are today.

The question is, three or six months after the GMT and 58 hit stores, will they be easy to get? I feel pretty confident they will, but we'll have to see.
