Update: I emailed the seller and told him the "4" gives away that it's two different items and I asked him which one he's selling. He immediately responded with this:

"I think U are mistaking
I really don't kno what U saying
U don't have to buy it
If there is Somthing U don't like then it's ok
U can look somwhere else"

I sent him a response to his email above telling him that the point is simple: the pics are clearly of two different items and, at the very least, he has included pics of at least item he's not selling.

He responded with "you are right, this is the one", and he attached two photos (same as photo 8 in listing). So he's admitting to a listing violation?
