Either fly and attend yourself (adding costs to the suit) or hire a representative who will act on your behalf.
I don't think anything else you suggested will have any clout and get results.
You can’t squeeze blood out of a Turnup. It’s obvious this Guy has fallen on hard times so he robbed the OP.Sadly the OP isn’t going to recover a dime even if he spends thousands on an Attorney.

i am pretty sure that losing a job almost immediately and having a record is doing him no good.

so the smarter way would be to pay me, even if its in separate payments.

it's my money anyway.

I hope this all gets sorted in your favour OP. The thief really is either an idiot or shameless as he’s still lurking on this thread.

There are no debtor prisons in the U.S. The judgement may dog his future efforts at employment but those of his ilk don't worry about that.

Being in business, I've been down the small claims route before and frankly I wouldn't even consider it again. It's pretty much a waste of time unless you feel that having a judgement against him is satisfying.
I’m curious about this. The small claims court on this side of the pond has the power to authorise seizure of goods from people against whom judgements are awarded and these seizures are carried out by “sheriffs” (bailiffs) who have pretty wide ranging powers which include forcing entry into commercial premises and impounding vehicles. I’m surprised to hear you guys don’t have anything similar. It kind of begs the question, what’s the point of pursuing anything via the small claims court?

I wish it worked that way here, but unfortunately not so. The only time small claims works out here is if the defendant doesn’t want a judgement hanging over their head and showing up on a credit report. Most of them just don’t care!

I hope he sees sense and you get your funds returned. Knowing his employer def works in your favor. One call to his HR would yield quick repercussions.

Some useful info in case it gets to the point of making a claim

If seller has assets, like home ownership, cars, other items of value, the amount awarded can be recovered. Worth checking the property tax records.

Crazy story. Good luck OP. I bet he still reads this thread. I'll help by putting some key words on this page for future google searches:

Young Oh, felon, scammer, Bank of Hope, Los Angeles, California, IT Manager, fraud

You should edit the title, so it doesn't show blame on Fedex

At this point can't we likely conclude that the fedex excuse was a lie? This guy wouldnt be on other forums begging for quick cash if it was really the fault of FedEx.

Young Oh should be more worried about his employer pressing criminal charges against him for using bank documents to commit fraud internationally than the OP bringing him to small claims court. He obviously didn't think this one through.

Be careful Darryll. These kinds of guys will say whatever you want to hear just to stall you a bit more. Stick to your resolve of skewering him if he doesn’t meet your deadline.

I got good news, at least i have won half the battle.

the seller agreed to give me the hulk instead of wire because he doesn't have the funds at all. he could have told he didn't have it and i would give him some time but instead he chose the stupid way and kept me running in circles.

got my friend to meet him up in Gardena LA, retrieve the watch from him.

now its in the safe hands of my friend.

i am happy to have gotten many text messages from all the friends i have made here. thank you all who contributed your input.

Now, on to phase 2, trying to find out what happened to the BLNR because seller claims that he has sent it for sure, went to fedex and got them to investigate.
so i told him to give me a update on it, via email.

let's see how it turns out

I really question he dropped the watch at FedEx.
Did you check with FedEx to see if they had an outage on the days he said he dropped it off?

my local fedex is running the cctv and system log as we speak.

they have done the checks in Singapore, no abnormalities.

now they're moving to the US ship centre for investigation

Wow! I wonder what happen on his end for him to do this. Based on his credit history, my WAG is that he's living beyond his means.

Exactly my thoughts.Maybe it took him a week for the knockoff to arrive which is why he stalled?
Hopefully this isn't the case, though.

Stolen watch by Fedex Outlet at California Gardena

If he’s really that strapped for cash, this guy had no business trying to keep a Hulk. I’d rather have zero possessions than to feel backed into a financial corner.

I cannot read all of this thread. It hurts my head.

Last year I bought a watch (by wire) from a trusted seller here. The seller didn't have the wire within 2 hours and I texted him a screen capture from my bank account's app that showed the amount of the wire deducted from my bank account and the wire confirmation from my bank. It was not some hand-written document that anybody could have done. There are a lot of methods of proving that you've sent funds - the seller didn't provide anything of substance.

I'm glad that the OP got (or is getting) a watch from this. My guess is that will be all he gets. And hopeful that the watch is legitimate.

Sad story indeed.
So you got a LV from him, hopefully it is genuine. Did he offer any explanation for giving you a fake bank wire document days ago? The same guy who facetime'd you and lied to your face... capable of anything.

I suspect he has given you a fake watch and I am in doubt he even had a BLNR in the first instance.

I hope you get this resolved, next time (if there is one) you must buy from a trusted seller.
