In one of the articles listed in this thread it says:

The spokesperson added: "If the goods remain in the EU, you have to pay tax and duty on them. That applies to everyone."

So if I'm to interpret this properly, if the watch does not go to auction and Arnold brings it back to the US, then there is no tax or duty and thus no criminal proceedings?? Seems to be a bit over the top IMO.
If Arnold had brought the watch into the country/EU as his personal wrist watch and left again with the watch on his wrist there would have been no import tax (and no duty which is minimal anyway).

But apparently he was caught walking through customs with a watch he intended to leave in the EU. The import triggers import tax - 10k in his case, no matter if imported for charity or any other purpose. His failure to declare results in criminal proceedings and a likely pretty substantial fine.

Totally agree but definitely not just the US. Journalism is dead everywhere - most places just report something said on social media or something another source has reported.
