Well I just spoke to PayPal and they said that the chargeback is under review, and usually Amex will hold onto the money for 40-70days because they legally can. Hopefully I recieve news that I get my money back. Honestly I wish he would've sent me that letter when I first inquired about the watch and none of this would have been brought to light. If what it says is true, I've already been refunded and the CC company hasn't let PayPal know. The first guy I spoke to said it was probably fake, but the chargeback specialist explained to me how the process all works. Supposedly they get $150 for every chargeback and they can have a second tier where I'll be able to submit more information if need be.

I'm glad jake decided to finally weigh in here and right now I believe things are being worked out. according to PayPal he could be telling the truth. I couldn't get through to the AMEX complaint center though. But have the case number from his letter so I'm going to try and find a way to speak to a real person there. there could be another round of evidence for me to send in to plea my case to the CC company to further confirm it was sold as described

FYI the buyer can't let someone pick it up to send back as he must have proof of postage and delivery for Paypal for the return.

Greg - just be aware that AMEX's customer is Jenny and the payment processor to you is PayPal.

Someone has retouched the original image of the AMEX Letter that was originally attached.

It's an arms length financial transaction for you. Only saying this since odds are AMEX won't discuss it with you.

Ok. Reading a bit deeper I have learned I will not do business with Beacon Hill Jewelers. I think I have been there in the past too.

I used to make custom guitars. Customer service is paramount, even more so if you want to survive in a digital age. I estimate you loose at least ten times the $950 in future lost sales and deflected customers. Sometimes you have to cut your losses.

If you took the high road and sent it right back, as any other member here would do, and you didn't get your refund, this entire thread would take on a different tone.

Very disappointing behavior for a mere $950. Really?

There's a few problems I found with the letter, 1 was that it was addressed to Jenny, but it says BHJ is the adress it was sent too so I didn't see too much weird about that. 2 was that there isn't a date. 3 BHJ has told me to call AMEX but I haven't found a way to get past their automation to confirm/deny this letters actual existence.

This is a scam. Buy a watch in poor condition, find something that isn't specifically described, file a claim with the credit card company and PayPal, that opens a labyrinth of legal horse pucky, seller gets frustrated and figures after awhile that getting the watch back will cost more than the value of the watch, gives up and buyer winds up with a free watch that can be restored and sold for a huge profit.

I've seen similar scams involving cars.

Really crazy to say the least.

PLAIN & SIMPLE: When you buy an item noted as NON WORKING there is risk associated with that purchase. Sometimes you eat the bear sometimes the bear eats you. Just like any business where reconditioning is necessary for resale. Its unreasonable to expect a refund, credit, or return on an item listed as non working. You took the risk.

It's also unreasonable not to open the claim with PayPal first. Why go directly to AMEX?
A claim with PayPal would have had the issue resolved with both parties much sooner and easier. There would also be a requirement for the buyer to show proof the item was returned, non of this I'm not willing to ship it BS.

If this is their standard operating practice then that's a problem. If there are multiple issues noted in the WatchOut section then maybe its time to BAN them.

Also props to Manny for stepping to the plate for a fellow TRF'er! Love the community here. Manny if you are ever in NYC let me know and the first rounds on me

I would send the "watch out" reports that have been highlighted here (Their record isn't good) to Amex and Paypal, get my money reinstated on that evidence and would then insist on getting the watch back before refunding the money to this less than stellar company. If the watch doesn't come back then all is good.

This is just bizarre. The buyer at one point mentioned that he tried to contact the seller for several weeks with no satisfaction, but it has not come up since??? If I were a buyer and had an issue with something that I bought and the seller did not respond for that long I would take swift action as well. But again, this has not come up since it was mentioned in an early post of the buyer.

The seller did a really good job of describing the watch and documenting its condition. I see no reason the buyer should have been surprised at the condition. To contact the seller and want $350 more off when he already sold a watch he had listed for $1300 to you for $950 is a strong arm move and just bad business.

I think that major issue for me (and it seems most others) is how the chargeback was handled. If the buyer had gone to PayPal and filed a complaint they would have refunded his money as soon As he provided proof that he had shipped the item. They always side with the buyer unless it is gross negligence on their part.

The whole Amex deal messed up the whole thing since PayPal is in the middle.

Adam - I don't think BHJ came to the forum to be part of the community so maybe reputation is way down on his list.

I noticed BHJ joined the same day the sale was posted as OHPF. So they were a 1-day old member upon purchase.

None of that excuses behavior but perhaps helps explain why BHJ seems unaware of the way we conduct ourselves here.
