If this transaction shows that there was INTENT to defraud it is a crime, not a civil case. Just to clear this up.

I'm sorry for your loss, but you said you had bought and sold watches for 15 years and you didn't think to check/verify that the funds deposited were cash and not a check...???

And, if someone was picking up the watch why didn't you insist that they just hand you cash at the trade off...

Something isn't right here....
That doesn't sound right. Writing and depositing a check written on a closed account is bank fraud, a bit more severe than a civil matter...

Writing a check on a closed account is fraudulent in the USA. Fraud is a criminal offense in all 50 states in the USA.

John, to correct you, you are incorrect...100%. Writing checks on a closed account is fraud and a criminal offense.

Wow that is like a bad movie. You will probably never let yourself live that one down. I would need a few secessions with a shrink. I would want that crooks head in my freezer. Lesson learned is cash is king.

I only do this in hopes that someone finds this watch (reward will be given!) and returns it to its rightful owner (ME!).

Yes, I do have proof of purchase. You can search under my username and see exactly what I posted when I bought it last year.

To all who have 'congratulated' me on being honest with myself and taking the higher road, thanks, but don't think for one second that I am not a human being and that I have not inherited $0.01 from anyone and that all my watches have been purchased with sweat/careful planning/hard work, so yes, I have decided to take it as a VERY expensive learning lesson, and would like to believe that I can "forgive and forget", but just as much, I would like to see the person(s) who did this suffer in excruciating pain for an indefinite period in time. As "luck" would have it, the preacher said on Sunday "make an effort to treat everybody around you as if he/she were your brother/sister". Talk about a challenge in this challenging time.....

Just need to remind myself that all of this is just material thing, and that if I made it once, I can do it again, I still have a roof and food on the the table, and I have MUCH more to lose (wife & kids) if I decide to take another route against those who chose to harm me. Expensive/tough lesson learned. My wish/hope is that it may help someone in the future.
Sorry to hear your lost. I hate scammers...You should post on "Watch out" section!
of watch serial numbers?

A $7k lesson is too expensive for me. I'd track (or hire someone) to track these dudes down and get my money back. These scammers need to know that they run the risk of messing with the wrong people. You have the driver's license information so you already have a lead.

GOB, don't beat yourself up, don't feel like this was your fault. You chose to trust someone. This is a good thing. The fact that he chose to step on that trust and cheat you doesn't lessen your higher standing. You are the better person and your "high road" proves this. Keep to the high road, but in the process remember that you have nothing to beat yourself up over. You thought you had an honest person and had made a legitimate deal. His underhanded fraud doesn't diminish your trust or honorable position.
Let the police handle the situation. Keep the new watch to remind you that YOU are the better person. To remind you that even though you were wronged, you were able to maintain your dignity and honor. For this, you shoukld wear the new watch with pride. You put your honor as well as the potential safety of your family above money and revenge. Congradulations and a huge round of applause to you. It is people like you, with honor, scruples and a trusting nature that makes me proud to be part of this forum.
You have my sympathy for your loss, but my respect for your attitude and for being the way you are.

Dave

Sorry to hear of your loss. There are a great many people out there who have lots of time to think of ways to cheat us, and we don't always have the time or the presence of mind to resist.

This story is a fair warning to us all.

I guess no closure has come to this?

Sad for the OP.

How checks can be allowed this day and age is a mystery to me. If I buy a 1 euro item with my CC, the machine has to call up my bank/cc company and check my account status. To place a 7K check... No "checkup" until much later.

YUP!!! Never hand your watch to anyone to look at ...they are all scammers, no matter how WIZlike they might sound. As for repairs, stand on their head till the watch is done. Walk in with the watch, walk out with the watch.
I have a 15yr old sub that ticks like new... I doubt I will ever need to take it to any shop....the other new watches I have, they will not need service for another 50yrs...
