Confusion between aftermarket and fake!

IMHO, aftermarket parts with Rolex hallmarks=fake
Even if clearly stated by seller.

Fake case means fake watch, it has rolex numbers engraved ? It is designed as a fake and that is what it is imho

Pos reported it's illegal to sell regardless of disclosure imho

I have started such a fake vs. aftermarket discussion before and although it should be quite clear what counterfeit means still I had a lot of people questioning the definitions and arguing on whether one fake piece on a watch makes the complete watch a fake.

Bottom line: Any integral non authentic Rolex part of a watch that uses the trademark Rolex makes the watch a counterfeit as a whole (so case, movement, dial). A counterfeit bracelet is just a fake bracelet, but does not make the watch as a whole fake. Only additions to an original part, such as aftermarket diamonds on a dial should not make the watch fake as a whole, unless with the intention to deceive the buyer. Aftermarket parts such as bezel inserts if not marked Rolex are no counterfeits, if described as such and with no intention to deceive a potential buyer.

In this case: as the case is marked 5538, which is a Rolex ref. No. the case is a fake and if the dial was redone including the Rolex marking it is a fake as well which in total makes 2 fake parts out of 3 essential parts of a watch, therefore the watch as a whole is fake!
