As far as I'm concerned, the seller should have IMMEDIATELY refunded the buyer ALL his money. All other issues are the seller's responsibility, including recovering any insurance monies, the watch, and the like. If the seller were uneasy shipping in a manner that would limit insurance recovery to less than the selling price, then the seller should either NOT have agreed to shipping in that manner, or made it clear in writing that the buyer would only receive $5000.00 back, in case the item was lost, stolen, or damaged in transit. Furthermore, if the seller policy was NOT to refund immediately but wait for receipt of insurance fund, in such a case, again, THAT should have been put forward prior to the sale, in writing, in order to obtain agreement from the buyer as to these terms. Absent such agreements, the seller was 100% wrong in how they handled this. I would have refunded immediately, without a hitch, for, among other things, I would have reserved all the funds in their entirety, until the buyer was in receipt of the watch, and totally happy with it, so refunding would have been easy. Sad state of affairs, with this seller.

My good name & reputation is worth way more than $1750. Now we know the value of the seller's.

If this type of behavior occured with a "traditional retailer" I have believe that the back & forth would have ended long ago. I feel terrible for Gus but the solution seems obvious: Police + lawyer = resolution. |

Sorry for leaving you all hanging,
Hi all just arrived home from some travel/vacation since the date of my last post, i didnt want to think about this while vacationing. Today i just received a personal check for $5000 (of course a wire transfer would have been the better way to handle the payment imho), i have just deposited the partial payment check tonight and will follow up as to if it clears or not. As for the balance, it is a mystery to me as to what the point of having to wait more time on top of the ridiculous amount of time that has already passed... Not to mention the nuisance of any further communication with the seller beyond the business and a simple posting of the facts. Its late here and i am exhausted from travel, i will read through the posts in the morning and address them. Cheers goodnight. Gus Ps after skimming the posts, i am utterly humbled by all of the support and your kind words my friends, thank you! Pps ill also share some pics of trip to brighten up this mess. Ill follow up tomorrow.
