Purchasing at an AD (and shipping out of state)?

Hello,
I've purchased out of state in the past and had items shipped to my house to avoid tax in a state that I don't reside, but I'm thinking about purchasing from an AD in my state and possibly shipping it out of state. Has anyone done this? How does it work?

I think AD at Las Vegas will do that for you unless that AD also has a store in your state

You should ask the AD about their specific shipping policies but I’m guessing the answer is “no”.

Mine will. One way is to just drive to the closest state border, book a night at a hotel, and have it shipped there.

I was gonna buy a watch and have them ship to my in laws.
I don't know if I trust hotels... and if you are going to do it, make sure you can them first to check if it is ok.

Call Fedex/UPS and ask if you can have something shipped to one of their facilities. I suspect they will need to associate the package with an in state residence, local to that facility, but I'm not sure.

Then of course the AD might have their own policy for shipping out of state. Start making phone calls. Let is know how it goes.

I considered shipping my recent purchase to my sister in CA to avoid sales tax, the dealer offered and would pay for it, and says they do it all the time. In the end, I was too impatient to wait a few days for it and just paid the tax.

UPS and FedEx will not ship to their facilities for pickup by you. Only to an address. However, they do have associated retailers like The UPS store etc that can hold a package for you.

I personally know an AD that refused to do this, saying it was illegal/fraud. YMMV though.

You will still owe tax, it is up to you to voluntarily pay tax in the state of you reside, should you ship it there.

However, what you can also do, is if you travel to an AD to a different state, you can purchase the watch and where it out of the store. The AD will then ship an empty box to where you reside. (i.e., you live in New Jersey but buy a Rolex from NYC.)

Good luck getting a dealer to do that...you're crossing into fraud territory there. My two preferred dealers have no issues shipping out of state, but they refuse to ship an empty box. In order to comply with tax laws, the goods have to be shipped out of state, not just the packaging.

Some ADs will let you wear the watch and just ship the box. I'm all for it although it is a fishy practice. And yes, it's true you still owe the tax on the watch in your state even if purchased elsewhere. But why go through the trouble of purchasing out of state if you intend to pay those. I'm a fishy person in that regard

My AD will do this for loyal customers- you have to fill out shipping address and then sign some form about being responsible for taxes which absolves the AD. at least that’s how my AD supposedly has done it though of course I myself would never shirk my responsibility to go out of my way and feed my State more $ to build a bridge to nowhere or the likes ..

I believe most states require you to disclose and pay use taxes on out of state transactions where taxes weren’t collected when you file your state return...failing to do so could be tax evasion.

I do it all the time. They fedex “it” to another state, and I have it fedexed back to me. Any AD will do it.

Only works if they don’t have a business in that other state you are shipping to.

Asking AD to ship the watch is fine....it's perfectly legal. Asking them to ship just the box and not charge you tax would probably make them feel very awkward. I doubt it is legal.

Doesn't change the analysis. If you live in a state that has sales tax, technically you are required to file a use tax return and pay the tax. Doesn't matter where its purchased. I know many people do not do this.

An AD shipping a box with its watch out of state without charging tax is perfectly legal assuming AD does not have a store in the state it is shipping to. It is done all the time.

Agree. I doubt a reputable dealer would even do this and I'd be embarrassed to ask.
