If this transaction shows that there was INTENT to defraud it is a crime, not a civil case. Just to clear this up.

Writing a check on a closed account is fraudulent in the USA. Fraud is a criminal offense in all 50 states in the USA.

Wow that is like a bad movie. You will probably never let yourself live that one down. I would need a few secessions with a shrink. I would want that crooks head in my freezer. Lesson learned is cash is king.

A $7k lesson is too expensive for me. I'd track (or hire someone) to track these dudes down and get my money back. These scammers need to know that they run the risk of messing with the wrong people. You have the driver's license information so you already have a lead.

GOB, don't beat yourself up, don't feel like this was your fault. You chose to trust someone. This is a good thing. The fact that he chose to step on that trust and cheat you doesn't lessen your higher standing. You are the better person and your "high road" proves this. Keep to the high road, but in the process remember that you have nothing to beat yourself up over. You thought you had an honest person and had made a legitimate deal. His underhanded fraud doesn't diminish your trust or honorable position.
Let the police handle the situation. Keep the new watch to remind you that YOU are the better person. To remind you that even though you were wronged, you were able to maintain your dignity and honor. For this, you shoukld wear the new watch with pride. You put your honor as well as the potential safety of your family above money and revenge. Congradulations and a huge round of applause to you. It is people like you, with honor, scruples and a trusting nature that makes me proud to be part of this forum. You have my sympathy for your loss, but my respect for your attitude and for being the way you are. Dave |

Wow it seems you can't trust anyone, everthing is going to sh#t. For me it's another reason for me to hang on to my Rolex, not selling it, or getting it repaired.

Sorry to hear of your loss. There are a great many people out there who have lots of time to think of ways to cheat us, and we don't always have the time or the presence of mind to resist.

This story is a fair warning to us all.
I guess no closure has come to this? Sad for the OP. How checks can be allowed this day and age is a mystery to me. If I buy a 1 euro item with my CC, the machine has to call up my bank/cc company and check my account status. To place a 7K check... No "checkup" until much later.
