Let me get this straight: You were in India, you are a US citizen living in the US and you gave an AD a deposit for a watch? You expect them to ship to you? I am not sure what the dealer did wrong. If he does not have the watch, he does not have the watch to send to you.

Rolex will not do anything. If you don't want your money back, then you will just have to wait I guess.

I'd just ask the AD for a refund and failing that, turn to my credit card issuer, if that's how I paid, and try to source one elsewhere.

Seems a little sketchy putting a full deposit for a product in a foreign country like India when you are based here in the US. I don't know how enforceable or what recourse you might have being that you are not physically in India. I might just ask them for your money back and see what they do. Do you happen to travel frequently to India? Just wondering how you even got connected to this AD.

My thoughts, too. I'm mystified why you would put yourself in the situation of having to engage in international dispute resolution, in the event things went south...which they now have. That said, if I were in this situation, I would ask for a refund and consider myself fortunate if I were to get the money back.

Like you I would never give payment in full until the watch is ready to be placed into my ownership the moment the money paid in full

He charged the 12.4k to a credit card over a year ago in Jan ‘17. Credit card issuer isn’t going to do anything 15 months later. Most give a 60 day window of protection for chargebacks.
And I disagree with ppl saying Rolex has nothing to do with this. An AD still represents the Rolex brand. Threaten to get Rolex involved if they refuse to deliver the watch or refund you. That may give you leverage. Realistically speaking, your best outcome is getting a 100% refund. Doubt you’ll ever see that watch from them. Sent from my iPhone using Tapatalk |

I contacted the CC company immediately after I was aware of the fraud and argued that I had informed them ASAP after I was aware of the fraud, so even though the payment was made 4 months previously here was no problem, I got my money back. I had my holiday and stayed at the hotel. I just paid directly at the hotel... But this ^^^ is not relevant anyway since the OP does not want his money back. |

Good point, there can be exceptions, especially if it’s fraud related. Or if you used an Amex. They tend to have the best protection and customer service by far.

How to file a Rolex Dealer Complaint
But the longer it has been since the charge, the less likely the CC issuer will help.
And I just realized I was making an assumption with him putting it on a credit card. Sent from my iPhone using Tapatalk |

take the money, wishing them to get you the watch isn't going to make it so.

It's good that they're willing to refund you. That's something at least. But obviously you'd rather have the watch than the money.
Instead of asking them when to expect it, have you asked them where you are on the list? Are you getting the next Daytona they receive? The 5th? The 20th? That seems like more relevant information. ADs don't know when they're going to get their Daytonas, but at least knowing how many people are ahead of you gives you some useful info. |

Also please keep in mind that the Daytona has shorter wait periods in India since its not a very popular watch in this region. People who spend this kinda money normally get a two tone or used gold watch.

India has more multi millionaires than France or Russia or Canada so i would think there is plenty of demand.

Then yeah, you're SOL. You'd be asking Rolex to compel an AD to deliver a watch that Rolex has deliberately made exclusive by limiting supply. The AD could simply claim they improperly estimated the wait time of a hard-to-come-by watch. Since they're offering you a refund, they haven't really done anything wrong, at least not that you can prove. I don't see what Rolex would do. Either wait it out, or get your money back. If it were me, I'd take the money.

I have an excellent longstanding relationship with my AD and was told a blue SS SkyD I wanted would arrive early fall 2017. It ended up arriving Nov 2017. It always takes longer.
I never pay in full and have never been asked that but I stick to my one AD. I’m not surprised the wait is taking much longer than initially quoted. |
