So let me be the bearer of some potentially bad news...
If the pawn shop owner does not agree to return your watch without compensation you will be faced with a dilemma. That dilemma is that you will have to hire a lawyer and sue him for the watch. This will take YEARS in Japan, not weeks or months. It will cost you THOUSANDS of dollars in legal fees and court fees. The pawn shop owner is no dummy, they have all been down this road before. Even after you can prove the watch is rightfully yours, you will have to prevail in court to get it back if he doesnt voluntarily turn it over. He will not be able to sell it either until the court proceedings is over, but at that point what does he care? He is out his money and giving it back to you wont help him recover his losses, only a hardline position for compensation will. I strongly suggest that if kindness and a good story dont persuade him to return it to you voluntarily, that you pay this guy some nominal fee to get it back. Get a receipt. When you finally do sell it one day, whatever you paid PLUS the amount you had to pay to the pawn shop will be your cost basis. You will only be responsible for any taxes on the profit above that cost basis. Hope he gives it back voluntarily, but it doesnt sound like he will. |

Wow great to hear, my heart sunk reading your story and was disappointed in the people that would do that to you. I'm glad to hear it was found and wishing you the best in recovering it.

It's always great to see stories like this that work out in the end. So glad that you're going to be getting it back.
As for the pawn shop: they were a victim as well in a way. Even if they were suspicious of the watch, they still handed over money for a stolen item that should be returned to you. It's a good sign that they did their due diligence to see if the watch was stolen and then reported it to the police, but you should not have to pay them anything in order to get the watch back. |

Agree with above poster. You may want to pay some nominal reward to the pawn shop to avoid lengthy litigation. The police can help on how much to give. Just a thought. And big congrats.

I would file a complaint by the local Police towards the pawn shop. They did not show due diligence when purchasing.
You stated that you warned them after your watch was stolen so they are guilty for buying stolen merchandise which is in my country considered a higher crime than the actual theft. Because of this kind of shady Mickey Mouse businesses thief's can sell their loot very easily, they need to be put out of business. Let's hope you have your watch back soon.

I don't know Japan law, but when the police tell you that you should pay the pawn shop, it might be trouble.
Good luck.

Good news - I'd give the shop a fee and be glad to get it back, if it's in good shape....
