Forget about the watch, I'm still trying to fathom how a 16 year old can own a business and enter into contracts??? Maybe he's emancipated??? In most states a minor can't enter into a business transaction without his parent's being involved. If they can't buy or sell a $500.00 car, how can they do the same with a $12,000 watch??

There is no legally binding contract to purchase watches. Cars require a contract. So, no laws would cover a purchase of a watch. No legal difference than buying a Timex from Wal-Mart. Just add a few zeros to the price. You don't expect them to be ID'ed for that do you?

I was dealing in antiques before my 16th birthday. (Which lead me to watches.) All you have to do is pay for the item.

In most jurisdictions a contract, put simply, has 3 elements.

1. An offer – this may be made when you decide to buy something and offer to pay a price.
2. An acceptance – this may be done by the seller agreeing to supply the goods or services. The acceptance may be in words or a written agreement or correspondence.
3. Consideration – this is the value (usually money) that is given in return for the goods or services offered to be supplied or acquired. It may also be the promise to pay at a later date after certain events occur or procedures are followed.

In many jurisdictions minors cannot be legally bound by a contract.

Praises for handling the situation professionally and making your customer whole. Without going into details of contract law, there are a few points that should be made.

Once Rob Spayne of Robert Maron, Inc. provided you an apraisal he became a party of the transaction. It is unclear if Jim took ownership before or after the appraisal from below. To help you in the future, it might be best if you use a neutral third party for authentication appraisals.

There seem to a number of members of bona fides here who conclude otherwise based on the content of this thread: that Luke Rottman's hand may have been forced on the refund, that he didn't handle the situation professionally, that the relationship with Maron is opaque / inconsistently described throughout this post and / or that as a would-be dealer, "Watch-Adviser," blogger and correspondent he treated the reasonable enquiries of a specialist forum dismissively, defensively and without candour. The invitation to respond further remains, of course.

The absence of such a response to a thread on one of the biggest, specialist fora in the field, a thread with 11,360 views where he and a watch he sold are the subjects, may be enough to prevent many people considering doing business with or giving ear to Luke Rottman / The Watch-Adviser again.

This hasn't even touched on the watch itself that was sold, or the sudden silence of the OP who had formerly been happy to post at length.

Slick website though..maybe..too..slick..
Wont be buyin from either of them though..
Wonder how many sales he lost and will lose because of this thread..
But between the other thread of him bringing in multiple Rolex from overseas..in a questionable manner..
And the ...my bank wont send a wire out after 1pm...
(I send wires out from my bank from dawn to dusk all the time..takes about 15 to 20 min..)
To... the..I was short of cash..thats why I didn't send it...
And actually putting all this double talk in writing online..for all to see..
And then not to send the Rolex to a good appraiser to actually find out whats really up w/it..
Speaks ..volumes..
