The sellers conduct is atrocious.
The seller is banned from selling anything again.

i had a face to face deal with Bob this year where he traded a DSSD for a Brand New Datejust II Rodium Diamond Dial. In that trade his watch was missing two links. after a few weeks we met again in Beverly Hills because he said he had the links. When I saw him, I see the links wasn't for a DSSD and i didnt take it. He promised that he will mail me a check for $100 as a replacement for the link. Long story short i am still two links short and no check.

John,

Many sellers here accept Paypal as an option. It is only true for a few sellers who do not take paypal. I for one is one of those sellers who do not. However, If i was the buyer, after i have proven that the package never received the buyer, i would right away refund the money. I know Gus personally and he is a stand up guy and can vouch for his honesty.

Im sorry this happened to you Gus. It makes me wonder if the package was insured for full value or at all. He needs to make it right. Period.

Gus,

Once, I sold a watch to the west coast from NYC.

The watch never arrived. The buyer and I both decided to wait and see what happens. Upon waiting for 3 weeks, I refunded the money to the buyer. The insurance portion is my OWN responsibility.

Fortunately, the watch showed up 2 months later mysteriously. The buyer was a gentleman, notified me and sent the watch back to me since he already bought another watch.

Bottom line, you should get your full 100% back.

My 2 cents.

Sorry to hear about this, but if would agree with everyone else, you should get all of your money back since you did not receive the watch.

Rob, refund the man his money back and you deal with USPS insurance claim. Step up and honor your obligation as a seller.

Sorry to hear about this..

I agree, this seller appears to be nothing more than a common thief in his dealings.

If the watch was not delivered through no fault of the buyer, the seller owes a complete refund to the buyer. Any insurance claimed is not for the benefit of the buyer, but covers the seller for him to recoup his loss in the case of misadventure..

USPS is supposed to be the safest method to ship because it's a federal institution... I personally prefer FedEx because it's the fastest and to me the most reliable. I have had to file a FedEx claim in the past and the funds were refunded to me within the week.

In regards to your situation... this 50% offer really is fishy. ESPECIALLY if he has asked you to sign some kind of release or something. Your emails definitely form a contract in case you want to go after him with a lawyer.

This was a reply by someone called Survivor in another thread about the safest way to send a watch.

Its the only way to ship if you want your package to be totally insured and secure. Fedex doesn't insure watches at all. Fedex is great until your package with your $10,000 watch is lost or stolen........same would be true for other carriers. USPS insures up to $5,000. I'd rather it take a bit longer than lose sleep.
If it was the Sub he had up for sale, then he only stands to get back 5000.
Thats why he only wants to refund 50%

If he sent the watch, I do believe he didn't insure it for the full dollar amount if at all.

Let's hope this guy chimes in and responds and has integrity which to this point he clearly doesn't. Another mention and at risk of sounding like a broken record: If a seller doesn't have plenty of solid feedback and isn't well known avoid as every scam thread we have ever seen here has that one thing in common. You don't see threads with our top sellers here with deals gone South/bad. Three are many stand up guys here so why gamble with an unknown when the result is a coin toss? The main reason is usually price and for a few hundred dollars have peace of mind and know you will get what you are promised and in a timely manner!

$5000 is indeed the max USPS will insure packages for, unless you go through a 3rd party insurance service that specialized in watches and jewelry.

USPS doesn't use any third party insurer. Read the thread also.

i have just sent a final offer for settlement to the seller due tomorrow Monday, banks are open.

if he declines im in it for the long haul.

again thanks for all the replies and insight into this rare and disappointing situation.

i would like to add that i have had many perfect transactions here on TRF with our trusted sellers and our members, like myself, who just dabble and find joy in collecting and trading.
This one transaction has not been the norm in my experience, and it is offset by otherwise all pleasant dealings.

cheers,
Gus

I want to see pics of the seller in handcuffs. I have no sympathy for this kind of breach of integrity.

Best of luck to you, Gus. Your attitude sets the example for all who face adversity.

Sorry for your loss and trouble.
By any chance did you ask the seller to take a picture of the USPS receipt? The receipt would show the amount of insurance and tracking number, if any insurance was purchased at all.
When I sell a watch to someone, and ship it via USPS I always take a picture of the USPS receipt and box and email that to the buyer. I think it builds confidence, because USPS can be very slow. I always used Registered, Insured for full value.

I find it interesting (disturbing) that you wired the money on 5/28 and his last TRF post was 5/30.

Asking the buyer to wait for the insurance money to come through sounds like a normal request from someone who's not in business.

However, the offer for a settlement of 50% is an absolute insult and an indication that somethings not right upstairs.

An honest person would never give that a second thought, much less act on it and then trying to shift the blame to the victim is highly indicative that you are being played for a pigeon.

Go for the throat.

You are correct about Registered mail. IF you are using USPS, people should use Registered Mail, insured, return receipt requested. Use that precise wording. Postal clerks will invariably attempt to talk you into certified mail or insured, but insisted on Registered. One of my very first jobs was as a postal clerk, do not let the postal clerk talk you into a lower level of mail.
