Someone just recently posted about how they were denied service by NY RSC because they couldn't provide a bill of sale, and it was a US-purchased watch. The owner sent the watch to Dallas instead, and had no problem. But the experience suggests there is some evidence of real-world refusal.

Interesting data point. I was not aware but have heard the NY can be a little more strict. A few friends of mine have sent their watches to Dallas with no issues and their name not on card. Thanks for sharing! |

This will probably take some time to be fully in place but the way Dera is describing it seems pretty acurate. At least he has a very good answer for any question asked. Wouldn't surprise me if we hear more buyers experiencing the same in the near future...

As long as the warranty card matches the watch and was originally purchased from and AD and is within the warranty period they will cover it. So many scenarios these days with unauthorized sales on the internet and no matter if sold by unauthorized dealers must still be covered and protected by consumer protection law. If a warranty is offered it’s on the product not who purchased it nor from where. As long as the warranty card is valid that is considered proof of purchase. Even without a card but proof of purchase it would still be covered. At the end of the day Rolex would not want a class action on a warranty denial protected under consumer protection law.

"valid" = correctly filled with the name of purchaser, as they say in their warranty conditions. Proof of purchase. Have you ever got one from a grey seller? |

I noticed this change in December when collecting my sub date, stickers removed, my name on the card then registered with Rolex, same deal with my wife’s Datejust 31, I say it’s a good thing and I don’t think any watch company should be made to transfer warranties.

Sure have, around 20. I’m the VP of a large national chain of brick and mortar stores that sells consumer electronics. So I’m very aware of the stance that manufactures want to hold but can’t. I don’t like it because it doesn’t help my business but it is what it is. All I’m saying is no matter what anyone or anything says if a product has a warranty and it’s within the warranty period and the consumer has a proof of purchase no matter if the name matches or not the manufacture will cover it. Even if it takes a little push like bringing up consumer law. I’d like to see them try to not cover one of mine purchased from a grey with someone elses name.

This "problem" will only last 5 years if even grey dealers have to put their name on the warranty card from now on.

However, 15 U.S.C. § 2301(3) excludes from its definition of consumer someone who buys a consumer product "for purposes of resale." That means a reseller is not a consumer, and warranties on consumer goods do not extend to the reseller. The question is, once a consumer good is purchased by a reseller who is not entitled to warranty protection under Magnuson-Moss, does the warranty "resume" once resold to a consumer? Or does the reseller constitute a "break in the chain" of coverage, rendering the warranty void from that point forward? We know where Rolex stands, but how is the Act to be interpreted? |

Can anyone advise if these new rules apply to Tudor as well?

I said I would remove the stickers myself when I got home and was told they had to be removed them before it leaves the shop as it’s one of Rolex’s stipulations |

I have to say, any time I considered buying gray or even pre-owned from the original owner, I always factored in some risk that an RSC may not honor the warranty.

The anecdotal reports with regard to the New York RSC would lead one to believe that Rolex USA/Rolex could care less about consumer protection statutes. Since New York RSC is a known serial offender it will take a successful legal action against them to set the standard for the rest of the country. Absent that it appears everyone should prepare to be treated as if they were in the New York market regardless of geography.

So if you buy one as a gift and have their name put on the card instead of yours it will have no warranty?

Japan Rolex ADs, I think, is way ahead of everyone with these “new” practices. I bought a Datejust 2 in a Japan AD thinking I would get a fully stickered watch. After resizing the watch, the saleslady returned the watch to me with all stickers removed. I was surprised at first but made no big deal of it. What surprised me even more is that they mail you the warranty card a month after you purchase the watch. I was told it was to prevent buyers going straight to grey dealers, which buys in-demand models higher than srp. I received the warranty card in the mail with all details, including my name, printed, not hand written. Looks way better than hand written warranty cards!

This is not an obligatory issue! The name written on the card can be x,y or z. Do you think it has any importance a name written with a pen? NO! The most important thing is that the card that matches the watch it's swiped at the moment of the purchase. This is exactly what my AD told me. He said the ONLY rule from Rolex is that the card is swiped at the exact moment of the purchase of the watch. That is how Rolex knows exactly when watch X was sold and what AD sold it so they are starting the 5 years warranty on the PRODUCT not on the buyer or on the name written on the card. The AD told me that this is the ONLY RULE from Rolex, the rest are recommendations.

Sorry but wrong on the BLNR. I deal with multiple AD’s and good friends with some large ones and all of them have wait lists for BLNR. Demand is as strong as ever and they are easily fetching well over retail. They are not easy to get similar to the Sub LV and D-Blue. So the hype is far from over regardless of what your AD said.

From my purchase about 10 days ago, I noticed nothing new about the entire process. AD let me leave the watches completely stickered, and did not name the warranty card. This time I actually witnessed the validation process for the warranty cards - they simply give it a pass through their handheld credit card terminals (the same terminal I used for my credit card to pay), "charging" a nominal amount to the card, and it spits out an "Approved" receipt. These types of terminals don't have any facility to enter a name - so it will be interesting to see if they will employ a new swipe system if registration in the buyer's name is done.

Wow, this thread caught fire... quick question for TRF veterans... how often in the first 5 years has anyone ever even used the warranty?
With the exception of some OCDers that send it in if a second or two is gained or lost during a day, I am interested to know if all this even matters that much |

Regardless of who's name is on the warranty, Rolex will honor it.
Many people receive a Rolex as a gift with the person who bought the watch name on it. OP I think your AD has seriously misunderstood the instructions from Rolex to completely remove the stickers when putting the watches on display. Many AD's take the watches and place them in a safe every night and as the employees are human they will eventually bump a few watches together every now and again. Also one other member here said that people try on the watches almost daily in the AD and without the stickers there would be marks all over the clasp. OP if you have a good relation with your AD please talk to them because I think they've really misunderstood the supposed new rules from Rolex. Sent from my SM-G950F using Tapatalk |

And this, is what takes the watch out of the AD’s inventory. Dual purpose. Starts the warranty clock and removes the piece from inventory to keep their turns (volume and timing of sales) up. The more you sell and the faster you sell it the more you get, generally speaking. If the ad never swipes the card the warranty is never activated and I am sure Rolex can deny that claim. Who cares who presents the watches and whose name is on the papers. If the serial number on the card that is presented matches the watch that is presented all RSC needs do is swipe the card or go to their database and see when the card was activated. If it was within the last 5 years and the watch isn’t reported stolen and the repair is covered under warranty, no issues. Card never activated or over 5 years ago, issues. Take the stickers off as soon as the AD receives the watch?
That can't possibly be true. Taking them off at the time of purchase? Sure. So there are going to be watches sitting in display cases being banged up and scatched because of this new rule? Who exactly is going to buy a new watch from a case that looks used?

I purchased a watch two weeks ago from my AD and nothing new in the process , I even told the manager that it was not for me and he left the warranty blank with no name , just the date and told me to put his name , stickers intact , nothing different from my previous purchases but again every AD is different, I still believe the warranty follows the watch.

Guess it all depends on the AD. The SD43 I just purchased from a grey had the name hand written on the warranty card literally two days before it was in my hands. Probably a smart move for Rolex to begin mailing warranty cards but it seems most AD's still doing it the usual way.

This warranty swipe is not about the warranty at all, it is about stopping watches going straight to greys. So the AD has to put the name of the grey on the warranty, if they are honest, but of course this will soon flag up grey repeat buyers, so the AD will be reluctant to be that honest. And if an AD puts a fake name, and even with fake ID, then he runs the risk of being terminated and maybe even prosecuted.
So probably a good move overall from Rolex, except that now greys are not needed any more by ADs, there is more than enough customer demand who can then flip to greys anyway. Until supply increases or demand falls, the market will stay as is. All they are doing is peripheral stuff, that just annoys customers and ADs and doesn't address the real issue. |
