As long as the watch does not have the markings, there is no trademark violation. A lot of folks use "Rolex style" to refer to a Datejust type watch...

I actually could not make it out. But saw the name was only on the title and not claimed on the "Brand" type.

Still a violation. Seller is using a picture of a Rolex GMT Master II. The watch he is selling has it's date window at the 12:00 position !

If you have time, do a web search for the actual watch he is selling. Rolex does not have a lock on the black/red bezel color combo. What he can't do is use the picture of a Rolex.

I went to the Voow company site, and while they didn't show the exact combination shown in the Ebay listing, I did grab a picture of next closest color combination.

When I compared the watches, It looks like the seller's picture has the Voow logo below the 12 position like the one on their site. So it appears that the seller is using the correct watch picture for the description in his listing.

That would mean that the listing is legit, correct?

Sorry the picture from the Ebay listing is so bad. It was tiny to begin with and my efforts to enlarge it only resulted in a blurry picture.

Kind ah sorta. He is still deceiving by using the Rolex GMT II statement. Most people that would bid that kind of auction don't bother to do the kind of research seen here on the forum.

Authenticity aside, you can't even say "Rolex Like" in your title. It's called Keyword Spamming, and it's a violation of ebay's policies. When people do a search, they don't want to see 1000 items that have "Not Rolex" pop up when they did a "Rolex" search. It's a very sensible rule. Title your item what it is, not what it's not. Imagine when Michael Jackson died, that I listed my item as "Michael Jackson Like Rolex Watch". It's all done to get more hits when it's not appropriate.

First, I'm looking at a bunch of items that are accessories that can be used with a Rolex, which is entirely different than listing a watch and calling it Rolex Like, or Not A Rolex. We need to compare apples to apples.

Second, even if 1000 people were selling their watches and calling them Rolex Like in the title, it doesn't mean it's not a violation of Ebay rules. Like with most rules, it needs to be reported on an individual basis for Ebay to do something about it. If nobody complains, and nobody cares, then it might just stay up. Not something I'd risk my ID and future on ebay over.

Apples to Apples, we were discussing writing "Rolex" on a title, whether Rolex Like (w/no trademark violations), or just "not a Rolex".... The same occurs when folks advertise accessories that will "fit a Rolex" (as with my example)...which is not a trademark violation unless it has the "markings.

I think you are contradicting yourself that "it doesn't mean "rolex like" it's not a violation of Ebay rules, BUT it needs to be reported...

I am not jumping at you, just showing there are hundredths if not thousands of listings with Rolex in the Title, and it is not a Rolex product.
